Recent Appellate Court Decisions
In PPG Industries v. IWCC, 4-13-0698 WC (4th Dist. 2014) the Workers’ Compensation Commission Division of the Illinois Appellate Court reversed a circuit court decision that had reversed an IWCC statute of limitations ruling.
In Sunny Hill Nursing Home v. IWCC, No. 3-13-0028WC (3rd Dist. 2014), the Workers’ Compensation Commission Division of the Illinois Appellate Court affirmed a circuit court decision which had confirmed the IWCC’s award of benefits.
In Matuszczak vs. IWCC, 2-13-0532 WC (2nd Dist. 2014), the Workers’ Compensation Commission Division of the Illinois Appellate Court affirmed the circuit court’s finding which had reinstated an Arbitrator’s award of TTD benefits for a petitioner who had not yet reached maximum medical improvement and had been terminated for cause.
In Young v. IWCC, 4-13-0392WC(4th Dist. 2014), the petitioner reached into a deep box to pick up a part resulting in a left arm injury. The appellate court held the IWCC’s denial of benefits was against the manifest weight of the evidence and found the claim compensable.
